The Militia is codified in the California law and the US constitution.
The “unorganized” or reserve militia is a legal and lawful part of the armed forces of this nation. It is an organization affirmed by the Second Amendment of the Constitution, US Constitutional laws and California Law:
The classes of the militia are:
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.
Every able-bodied male citizen of the respective States, resident therein, who is of the age of eighteen years and under the age of forty-five years, shall be enrolled in the militia.
The National Defense Act of 1916 , Pub.L. 64–85, 39 Stat. 166 SEC. 57:
The militia of the United States shall consist of all able-bodied male citizens of the United States and all other able-bodied males who have or shall have declared their intention to become citizens of the United States, who shall be more than eighteen years of age and, except as hereinafter provided, not more than forty-five years of age, and said militia shall be divided into three classes, the National Guard, the Naval Militia, and the Unorganized Militia.

There is no ambiguity, the “unorganized” citizens militia. It is not the National Guard or the state “select” militia under the governor, or part of the “organized” armed forces of the federal government. It is literally the entire body of the armed citizenry.
Although the “unorganized” militia can be called up for lawful (Constitutional) purposes, it is not under the direct control of any state or political jurisdiction. It represents the authority and power of the people over the government and stands as the last defense of the citizens of this country against any domestic tyrants. Militias also do not need to wait until called for a natural disaster.
California State Militia (CSM) is statewide. Members are welcome to join any Company that makes up the 2nd Regiment. Not all counties are currently covered by a Company but citizens in uncovered counties are welcome to join any company or start their own in their area if so motivated.
A political action group is organized to promote a group of individuals ideals. While all of our members have ideals, they are not always the same.
ALL of our members are allowed to think and do what they see fit as private citizens.
Our Militia as an organization takes no side politically.
We do not express support for political candidates.
We promote the “Rule of Law”, and train to protect those rights outlined in the constitution for our families, friends, and communities.
Our organization trains to meet the readiness requirements of “unorganized” Militia as defined by laws. Our military orientation allows us to maintain discipline, and perform community services professionally and safely.
Our members may participate in both. But, the militia prepares, trains, and equips as a response group in the fashion of Minutemen of Concord and Lexington for the defense of self and community.
We strive to be respected, and thought of, as a bona fide Militia unit.
Our organization has Written codes of conduct, Military style organizational structure, A distinctive uniform with identifiable unit patches and “logo’s”, A flexibly evolving training program, Standard Operating Procedures (SOP’s). All these items are for the purpose of the defining ideal: A “well-regulated” Militia as stated in the Second Amendment.

The authority, duty, and obligation of the citizens, acting as the militia, is clearly expressed in our Declaration of Independence. Together these provisions codify the natural rights of all citizens to the defense of self, family, and country.

To uphold and defend: The Constitution of the United States of America, The Constitution of the State of California, and the Bill of Rights: seen as inalienable, and given by our creator to free men that they may remain free.
To support our County Sheriff’s Department. To ensure that all citizens– regardless of race, color, religion, sex, physical characteristics, or national origin — shall have the right and opportunity to due process of the law as established and guaranteed by the Great Document which guides this Great Nation.
To provide emergency support to our communities in the event of a natural disaster through the participation in CERT, local town activities and in support of our local governments and County Sherriff
It is the goal of the 2nd Regiment to:
Loyalty – unwavering support and allegiance directed towards to the U.S. Constitution, the State Constitution, your unit and other Patriots
Duty – Performing whatever task is assigned to you to the best of your ability. Fulfill your obligations.
Respect – Respect does not only extend to individuals but also to your surroundings and equipment. Treat people, places, and things as they should be treated.
Selfless Service – Place the welfare of the Nation, the State, the Militia and your fellow citizens before your own.
Humility & Honor - The integrity to see the truth and admit mistakes. To do what is morally sound at all times. Without humility, there can be no honor.
Integrity – A personal quality of fairness that all members should aspire to. A personality trait that means a person has a moral compass that doesn’t waver.

Members of the 2nd Regiment are encouraged to procure and maintain items of uniform and equipment. When in uniform, members represent the 2nd Regiment. Therefore, members uniforms will be clean, buttons buttoned, shirts tucked in, and patches either attached with Velcro or sewn on properly. The proper impression is very important to the public.
The primary weapon of a 2nd Infantry Regiment member will be the rifle. Caliber is at the member’s discretion however; it must be in accordance with the law. It will be required of all militia members not otherwise opposed for conscience sake, to have their own rifle, ammunition, and equipment.
Militia members are always required to remain proficient in the maintenance and safe operation of the rifle and to have a minimum of 400 rounds of ammunition and 150 rounds per sidearm available.
The militia member’s equipment shall consist of necessary items to be determined, based on the member’s assignment. Thus outfitted, the equipment will always be kept available for rapid deployment by the militia member. If a member is restricted to limited funds, priority is proper uniforms and basic equipment rather than exotic military hardware. A professional image is more creditable than a lot of neat toys.
Militia members ARE expected to obey all Constitutional Federal, State and Local firearms laws. Militia members are normally expected to carry firearms. Only in self-defense will a militia member discharge his weapon. As with members of organized units within California, militia members are expected to abide by all hunting rules and regulations pertaining to the use of firearms for that purpose.
In the case of any disaster, threat or invasion, the role of communication is critical. Therefore, radio and ham radio will be the principal forms of communication for the 2nd Infantry Regiment. Persons taking part in emergency communications should have a valid GMRS or ham radio operator license.
Members must discipline themselves to set aside time each month, for assembly. The 2nd Infantry Regiment trains EVERY 3rd weekend (Sat/Sun) of each month. Occasionally the weekend may change based on holiday or other needs. Militia members will be notified of actual assembly times and places. While it is intended that the militia intrude as little as possible in the private lives of its members, it is also clear that individual members are volunteers and have made a commitment to the Militia and must be ready to meet periodically and to deploy as the need arises. It will be the objective of the staff to infringe as little as possible on the time of militia members, recognizing their responsibilities to their families and jobs.
